Prohibition of COVID-19 Vaccine Passports - May 25, 2021
Governor Brian Kemp issued an Executive Order today that prohibits the implementation of COVID-19 Vaccine Passport Programs by state agencies, providers of state services, or state properties. It further provides that no state or agency employee shall be afforded employment-related privileges, accommodations, or circumstances of employment or otherwise be held subject to different rules or requirements that other employees based solely on the COVID-19 vaccination status of such employee if actual proof of vaccination status is required in order to qualify for any such privileges, accommodations, circumstances or different rules and requirements.

The EEOC enforces workplace anti-discrimination laws, including the Americans with Disabilities Act (ADA) and the Rehabilitation Act (which include the requirement for reasonable accommodation and non-discrimination based on disability, and rules about employer medical examinations and inquiries), Title VII of the Civil Rights Act (which prohibits discrimination based on race, color, national origin, religion, and sex, including pregnancy), the Age Discrimination in Employment Act (which prohibits discrimination based on age, 40 or older), and the Genetic Information Nondiscrimination Act.
